Terms of Service

Agreement

These Terms of Service ("Terms") govern your access to and use of Trakart's websites, mobile experiences, and related services (collectively, the "Service") operated by Trakart ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Trakart. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with permission of a parent or legal guardian who accepts these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it as described in our Privacy Policy.

Your account

You are responsible for safeguarding your login credentials and for activity under your account. You must provide accurate information and keep your profile information up to date. You may not impersonate others or create accounts for abusive or automated purposes.

We may suspend or terminate accounts that violate these Terms or our Community Guidelines, or when required by law.

Your content

You retain ownership of creative works and other content you upload, post, or display through the Service ("Your Content").

You grant Trakart a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for technical purposes such as transcoding and generating thumbnails), publicly display, publicly perform, distribute, and promote the Trakart Service using Your Content, solely to operate, improve, and market the Service in ways connected to your use (for example, showing your post in feeds, search, and reasonable promotional materials featuring creators on Trakart). This licence ends when Your Content is deleted from our systems, except where retention is required by law, legitimate dispute resolution, or enforcement of these Terms (including moderation evidence holds).

You represent that you have all rights necessary to grant this licence and that Your Content does not violate law or third-party rights.

Artificial intelligence

Product commitment (pending final legal review): Trakart does not use Your Content to train general-purpose artificial intelligence models. We use automated tools from service providers (such as OpenAI and Sightengine) only to help detect policy violations and safety risks in content you submit. Those providers process content under their API terms and our agreements with them.

Prohibited conduct

You may not use the Service to violate law, infringe intellectual property, harass others, distribute malware, scrape or reverse engineer the Service except as permitted by law, or interfere with security or moderation systems. See our Community Guidelines for detailed rules.

Moderation and removal

We use automated and human review to enforce our policies. We may remove or restrict content or accounts, with or without notice, when we believe there is a violation or risk. When we remove your content for policy or legal reasons, we may notify you with a statement of reasons where required by applicable law.

Reports of child sexual abuse material are handled under our safety procedures, including preservation of evidence and reporting to appropriate authorities such as the National Center for Missing & Exploited Children (NCMEC) where required by U.S. law.

Account deletion

You may delete your account in settings. Deletion begins a grace period (currently 30 days) during which your profile and content are hidden and you may restore the account. After the grace period, we permanently delete your account and associated data, subject to legal retention and safety holds described in our Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAKART AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

Indemnity

You will indemnify and hold harmless Trakart from claims arising out of Your Content, your use of the Service, or your violation of these Terms or law, to the extent permitted by applicable law.

Dispute resolution

Counsel to insert governing law, venue, arbitration or court process, and consumer mandatory rights (EU/UK) before launch.

Changes

We may update these Terms. We will post the new version and update the version identifier. Continued use after the effective date may require renewed acceptance where implemented in the product (`termsVersion`).
