Copyright and DMCA Policy
Respect for creators
Trakart respects intellectual property rights. Users must only upload content they own or are licensed to use.
Trakart's role
We host user-generated content. We respond to notices of claimed copyright infringement consistent with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws.
Designated agent
Our DMCA agent is registered with the U.S. Copyright Office [registration pending]. Send notices to:
DMCA Agent — Trakart [Street address — placeholder for Copyright Office registration] Email: copyright@trakart.app Phone: [placeholder]
Only copyright complaints should be sent to this address. For other issues, use support or in-app reporting (`IP_INFRINGEMENT`).
Takedown notice requirements
To be effective under 17 U.S.C. § 512(c)(3), your written notice must include:
1. Your physical or electronic signature 2. Identification of the copyrighted work claimed to have been infringed 3. Identification of the material on Trakart and information reasonably sufficient to locate it (URL, post ID, @username) 4. Your contact information (address, telephone, email) 5. A statement that you have a good-faith belief that use is not authorized 6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rights holder
Upon receipt of a valid notice, we will expeditiously remove or disable access to the material and notify the uploader.
Counter-notice
If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the agent above including:
1. Your signature 2. Identification of removed material and its prior location 3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake 4. Your name, address, and consent to jurisdiction of the federal district court for your address (or Trakart's if outside the U.S.) 5. Consent to service of process from the complainant
We may forward the counter-notice to the complainant. Unless the complainant notifies us of court action within the statutory period, we may restore the material.
Repeat infringer policy
Trakart will terminate accounts of users who are repeat infringers in appropriate circumstances. We track substantiated copyright removals and apply escalating action (warning, suspension, termination). Details are enforced per our internal DMCA runbook.
In-app reporting
Users may report suspected infringement using report reason IP infringement. This does not replace a formal DMCA notice from the rights holder when safe harbor procedures apply.
Trademarks
This policy addresses copyright. Trademark complaints may be sent to [copyright@trakart.app — placeholder] with similar identifying information.
